Welcome to O-KIVA. These Terms and Conditions (the «Terms») govern access to and use of the O-KIVA platform, available at o-kiva.com (the «Platform»). By creating an account or using the Platform, you accept these Terms in full. If you do not agree, please do not use the Platform.
O-KIVA is a marketplace that connects verified talent (artists, performers and event service providers) with organizers and agencies. O-KIVA facilitates talent discovery, identity verification, quote requests, communication between the parties and booking management. O-KIVA acts as a technological intermediary: it is not an employer, representative or party to the agreements the parties enter into with each other, unless expressly stated.
O-KIVA is operated by Urbina Entertainment, LLC, a limited liability company organized under the laws of the State of Delaware, United States (the «Company», «we» or «O-KIVA»), with registered address at 131 Continental Dr, Suite 305, Newark, DE 19713, New Castle County, Delaware, USA, and Employer Identification Number (EIN) 61-2364796. Payments and payouts are processed through Stripe.
To use certain features you must create an account. You are responsible for the accuracy of the information you provide and for keeping your credentials confidential. There are different roles — talent, organizer and agency — and each enables specific features within the Platform. You must be of legal age and have legal capacity to contract.
O-KIVA verifies the identity of talent through a verification process that may include the review of identity documents. Verification aims to protect the community and give organizers confidence. The processing of this data is described in our Privacy Notice.
By using the Platform you agree not to:
Talent and agencies may upload content (photographs, videos, descriptions and profile materials). You retain ownership of your content, but you grant O-KIVA a non-exclusive license to host and display it within the Platform in order to promote your profile to organizers. You are responsible for holding the necessary rights to the content you publish.
Organizers may request quotes and book talent through the Platform. The conditions of each service (price, date, scope) are agreed between the parties. O-KIVA applies a commission for the use of the Platform, which is always clearly displayed before you confirm each transaction. Payments are held in escrow by O-KIVA and only released to the talent once the event is completed. Payments are processed through a secure payment provider; O-KIVA does not store your full card details.
Each booking is subject to a cancellation policy that is displayed before payment. If a disagreement arises, either party may open a dispute from the Platform; O-KIVA will review the case and may withhold, release or refund the funds held in escrow in accordance with that policy.
The O-KIVA brand, its logo, the design, the texts and the software of the Platform are the property of O-KIVA or its licensors and are protected by applicable law. No rights over them are granted other than normal use of the Platform.
O-KIVA may suspend or cancel accounts that breach these Terms, that pose a risk to the community or that misuse the Platform. You may also request the deletion of your account at any time by writing to us at hello@o-kiva.com or through the contact form.
The Platform is provided «as is». O-KIVA does not guarantee hiring, the quality of the services provided between the parties or specific results. To the extent permitted by law, O-KIVA shall not be liable for indirect damages arising from the use of the Platform or from agreements entered into between users.
We may update these Terms to reflect improvements or legal changes. We will publish the current version on this page with its update date. Continued use of the Platform implies acceptance of the Terms in force.
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-law provisions. For any dispute, the parties submit to the jurisdiction of the competent courts located in the State of Delaware, waiving any other forum to which they may be entitled.
